Napster Wars Essay Fifth Amendment?A young Shaun Fanning, attending school in high school in Harwich, Massachusetts had two loves: 1) Sports ( baseball, basketball, and tennis ) and 2) computers. As his curiosity grew for computers, he decided to stop his sport playing, and spend most of his time working with computers. He primarily focused on two aspects of the computer, programming and the Internet. His computer fascination grew into an obsession throughout high school. His freshman year at Northeast University in 1998 was spent trying to enter computer science classes higher than the entry level. Not finding anything challenging about the courses, he decided to start writing a Windows based program in his spare time. He started spending time in IRC chat rooms with experienced programmers who knew the tricks of the trade. Shauns roommate loved MP3s, but disliked the unreliability of old sites, and having to search endlessly for songs that were usually not even available. With this in mind, and his developing skills as a programmer and his curiosity for the internet, Shaun decided to write the Beta for Napster. He used the idea of all users being connected to one central computer server, yet all having access to each others music files. He wanted a continually updated list of songs to choose from. He wrote a small version and distributed it to friends and family. The results were all positive. He had fellow programmers detect bugs, and perfect the program. Napster got its big break, when it was featured as Download.coms featured download. The system would be revolutionary, he thought. A sharp contrast to the traditional search engines, this community would be user powered, based only on what the us ers want to share with other users. After the advertisement on Download.com, Napsters user count sky-rocketed. Shaun was on the right path. How creative! This creativeness would soon turn to turmoil (Fanning p.1).? ?On May 8, 2000, the Recording Industry Association of America sued Napster and its founders for music piracy(Borland p.1).? It is really a battle of individual rights and ingenuity, as opposed to copyrights. It has quickly moved its way up to the US Supreme Court and has the media as well as the public hungry for the latest reports. Napster can be downloaded and installed for free on your computer. I have chosen to view this issue in perspective of the Fifth Amendment. Technically, yes. Read over again, the last sentence of the Fifth Amendment, , and notice the part reading no one to ?be deprived of life liberty or property without just compensation. In that statement the Fifth Amendment is briefly backing up the positions of both sides of the court case. Both are trying to take each others personal property away. The RIAA is trying to shut down Shaun Fannings program, which he owns full rights to, and Napster is freely distributing copyrighted songs, which have owners. Federal laws provide that you cannot distribute whole copies of copyrighted material freely, without giving any royalties to the owners of that music. Napster provides the well thought argument that they are not providing and conducting the song trading, but merely providing a ?electronic housing? for its users. But when it is not hurting anyone except for a very select few people, who are already wealthy off money made from these exact songs, should these technicalities be enforced? Even more so, when it is benefiting many more people that it is inconveniencing, should the laws be carried out to a ?t The RIAA is saying yes. Claiming that many musicians are angry that Napster is freely giving out songs that belong to them, without any just compensation. We can definitely deal with the issue of individual rights as opposed to the good being done for the larger part of society. The very select few who are being affected in a negative way in this matter, are the musicians themselves. Among the supporters of the anti-Napster movement are Eminem and Metallica. Many more people are benefiting off Napster rather than people being inconvenienced. I personally, can say that Napster is very helpful in the retrieval of music files and is a fresh alternative to boring search engines. The musicians individual rights, however are blatantly being violated, and in turn, they want com pensation. The reason the case has held for so long in the Supreme court, though, is the vast number of people that give it their support. Why would you want to destroy something that provides an easy, fun way to do your file to file sharing. Straying away now, very quickly from the whole Amendment aspect of the case, lets settle down and review the public service issue of this. I am arguing towards the fact that this type of public service, is totally acceptable, because hard work was put in, and his great success was not intentional. He was planning on running a little network between friends and family members, so they could trade songs more easily. It was a hit and it exploded. Now his company and he has to suffer and pay money towards the records companies for trading copyrighted materials that was merely set up by him? Thats not right. Beowulf And Monster Beowulf is the epic story of a young hero who battles the monster Grendel and his mother. Beowulf, a prince of the Geats, the son of Ecgtheow who voyages to Heorot, the hall of Hrothgar, king of the Geats and the great grandson of the hero . There at Heorot, Beowulf destroys the monster Grendal, who for twelve years has haunted the hall by night and slain all he found therein. When Grendal's mother, in revenge, makes an attack on the hall, Beowulf seeks her out and kills her in her home beneath the waters. There are many different events in this story. First, there is the pagan warrior system. In this system, the relationship between the lord and his men, known as the thanes, is very important. It is the responsibility of the thanes to defend their king and their lands and also to fight his wars whenever possible. The relationship between the lord and the thanes is one of mutual trust and respect. The warrior vows his loyalty to his lord and eventually becomes his companion. In return, the king/lord is responsible for repaying these men for their favors and eventually provide for their households. He offers them shelter, helmets, gold rings, bracelets, swords, beer, mead, and a home. (Norton, 23.) In the warrior society, there are two forms of retribution, quiet vengeance and the wergild or the "man price" (Norton, 23.). A killer is responsible for paying for the death of a warrior, by paying a member of his family: "Each rank of society is evaluated at a definite price, which has to be paid to the dead man's kinsmen by the killer who wishes to avoid their vengeance - even if the killing has been accidental." (Norton, 23.) There are also the ideas of fate and courage portrayed throughout the story of Beowulf. The warriors believe that fate controls their lives and their beings. Beowulf, the ultimate hero, shows this trait throughout Grendel's attack and also in his battle with Grendel's mother after her vengeful attack on the hall of Heorot. He even tells Unferth, the boastful warrior, of his fate before defeating Grendel, when Beowulf says, "Fate often saves an undoomed man when his courage is good." (Norton, 34.) After, Beowulf's successful victory over Grendel, the warriors enjoy their feast and then settle down for their night's rest in the great hall Heorot. They do not know that Grendel has a kin who will come that night to avenge his death. Grendel's mother then arrives and snatches the first person she sees and hurries back to the mere. When it is discovered that the man, who happens to be Hrothgar's dearest advisor, Aeschere is dead, everyone is sorrowful. Once again, all of Danes are now in sorrow for the death of Aeschere. Hrothgar mourns his friend's death, but Beowulf encourages him when he says to Hrothgar, "Sorrow not, wise warrior. It is better for a man to avenge his friend than much mourn." (Norton, 45.) Beowulf now attacks Grendel's mother and gives victory and freedom to the Danes over the monsters that have been plaguing them for over twelve years. Hrothgar is described as a "hoary warrior". (Norton, 45.) He is old, tired and cannot control his kingdom. His thanes can boast, but cannot face the monsters that try to overthrow his kingdom. Not only does Beowulf shows his courage and his fighting ability as a young warrior, but in the end of the poem, at an old age, he again shows his courage by attacking the dragon who eventually takes his life. At the time he is about to attack the dragon, Beowulf says, "In my youth I engaged in many wars. Old guardian of the people, I shall still seek battle, perform a deed of fame, if the evil-doer will come to me out of the earth-hall." (Norton, 59.) Beowulf's successor is Wiglaf. Wiglaf is the young warrior who sticks by Beowulf's side while he fights with the dragon. Wiglaf is very similar to Beowulf in that he is also courageous and is humble. He is very courageous and shows his courage when he tries to help Beowulf attack the dragon.

Definition and Examples of Polemics Definition Polemic is a mode of writing or speaking that uses vigorous and combative language to defend or oppose someone or something. Adjectives: polemic and polemical. The art or practice of disputation is called polemics. A person who is skilled in debate or someone who is inclined to argue vehemently in opposition to others is called a polemicist (or, less commonly, a polemist). Enduring examples of polemics in English include John Miltons Aeropagitica (1644), Thomas Paines Common Sense (1776), The Federalist Papers (essays by Alexander Hamilton, John Jay, and James Madison, 1788-89), and Mary Wollstonecrafts A Vindication of the Rights of Woman (1792). Examples and observations of polemics are given below. Kshathriya people had the right to rule the country while the other two were the working class. The word Brahmin is derived from the word Brahman ie the supreme self. This caste is traditionally ranked first, among the four main castes. Vedas are the primary source of knowledge for brahmins. The word Kshtriya denotes an aristocratic status. In Sanskrit it is derived from the word ââ¬Å"Khatraâ⬠ie Power, Rule, Roof, Government etc.. This caste is traditionally ranked second in the four main castes. The Vaishya are on the third rank of four main castes in Indian society. The word Vaishya is derived from a word which means to live, and the caste was originally focused on farming, agri culture, and trading. The shudras are the lowest and largest caste. As per the Sanskrit definition, Shudra can be any person, regardless of his Varna. As per the Purush-Sukta of Rig-Ved,the Shudras are originated from the feet of the Lord (Brahmana-Kshatriya-Vaishya-Shudra) Hindus believe in ââ¬Å"The three-in-one god known as ââ¬Å"Brahman,â⬠which is composed of: Brahma (the creator), Vishnu (the Preserver), and Shiva (the Destroyer)â⬠(Hindu Beliefs). In other words, for every Godly activity, Hindus have a separate God. They believe that the entire world is controlled by different Gods who have different duties.
